THE UNDERSIGNED PARTICIPANTS:

 

1. HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Unique Vacations Inc., including but not limited to, its subsidiaries, affiliated and related companies, their respective employees, officers, directors, predecessors, successors and assigns, along with participating businesses, and any other sponsors and all of its holdings, and owners and lessees of premises used to conduct the event and each of them, their officers and employees; all for the purpose herein referred to as "releases," from all liability to the undersigned, their personal representatives, assigns, heirs, and next of kin for any and all loss of damage, and any claim or demands therefore on account of injury to the person or property or resulting in death of the undersigned, whether caused by the negligence of the releases or otherwise while the undersigned is participating in the event.
    

2. HEREBY AGREE TO INDEMNIFY AND SAVE HOLD HARMLESS the releasees’ from any loss, liability, damage or cost (including attorney's fees) they may incur due to the presence of the undersigned participating in the event and whether caused by the negligence of the releases or otherwise.
    

3. THE UNDERSIGNED PARTICIPANT agrees that while participating in this event, the use of alcohol or any substance which may affect the ability of the participant to participate safely in the Run, or any other activity which may be considered hazardous to the health and safety of said participant or other participants and /or spectators, is strictly forbidden.
    

4. HEREBY ASSUMES FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE due to the negligence of releases or otherwise while participating in the event.

 

THE UNDERSIGNED expressly acknowledges and agrees that the foregoing release, waiver, and indemnity agreement is intended to be as broad and inclusive as is permitted by law of the State of Florida and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

 

THE UNDERSIGNED expressly acknowledges that there are inherent risks with physical activities, and he / she freely assumes all risk, including the risks of personal injury, death, or disability arising from the participants voluntary participation in the Run and related activities, including accidents, collision, falling, exposure, overexertion, or weather conditions, as well as all unforeseen risks. Additionally, the undersigned hereby attests that he / she is in good health and medically fit to participate in the Run.

 

THE UNDERSIGNED acknowledges that transportation is provided to the event (departing from and returning to Unique Vacations Inc’s corporate office) for those persons interested in traversing voluntarily to the event in the aforementioned manner and Unique Vacations Inc. As such, participant hereby voluntarily releases, waives, discharges, holds harmless, defends, and indemnifies Releases against all claims associated with travel, including bit not exclusive to actions or losses for bodily injury, property damage, wrongful death, loss of services, or otherwise, which may arise as a result of the providing of transportation services to, and from, the Run

 

THE UNDERSIGNED expressly acknowledges that any and all minors permitted to be brought to the event, accompanying a parent and/or guardian to the event, attending the event, and/or participating in the event, must be accompanied and supervised at all times by a parent and/or legal guardian. Unaccompanied minors will not be permitted to participate in and/or remain at the event. By bringing or accompanying a minor to the event, the parent or legal guardian acknowledges and agrees that they are solely responsible for the care, supervision, and conduct of the minor at all times. Furthermore, the parent and/or legal guardians agree to release, indemnify, defend and hold harmless the event organizers, sponsors, volunteers, and any affiliated entities (“collectively, the “Race Hosts”) from and against any and all claims, liabilities, damages, losses or expenses (including reasonable attorneys’ fees) arising out of or related to the minor’s participation in the event, including but not limited to any personal injury, property damage, or other loss suffered by the minor or caused by the minor to others.

 

THE UNDERSIGNED HAS READ AND VOLUNTARILY SIGNS THE RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT, and further agree that no oral representations, statements or inducements apart from the foregoing written agreement have been made.

 

I understand and accept that in the course of my attendance at and participation in the "Unique Vacations Inc.’s Jilly 5k Run", film or photographs may be taken, or illustration may be made of me and/or my personal property. I acknowledge and agree that such film/photographs and/or illustrations may be used in any medium by the Unique Vacations Inc. and all its related entities and agencies for advertising and promotional purposes in any medium, without compensation to me.
